Options for STEM & Beyond

  • EB-1A Extraordinary Ability: This is for individuals who have exhibited distinction in their field in the sciences, arts, education, business or athletics; national or international recognition, sustained achievement or contributions of major significance.
  • EB-1C Multinational Executive or Manager: The two ways to gain EB-1C status are to apply for an Adjustment of Status (if already in the U.S. under L-1A status) or abroad at a U.S. consulate. There must be a qualifying relationship between the U.S. company and entities abroad, a minimum 1 year of continuous employment in the three years preceding the petition and the position must be in an executive or managerial capacity.
  • EB-2 NIW National Interest Waiver: For those who can demonstrate exceptional ability in their field of practice, but to a lower extent that’s required for an EB-1, the EB-2 NIW is a suitable pathway. You must be able to demonstrate that the business strategy or endeavor has substantial merit.
  • EB-5 Immigrant Investor Program: This is a leading capital-based green card pathway that has stringent requirements including a minimum investment amount of $1.05 million in a new commercial enterprise or $800,000 if the investment is made in a targeted employment area (TEA).
