What is the EB-1 Green Card?

The EB-1 is a first-preference green card pathway for those with extraordinary ability (EB-1A), outstanding professors or researchers (EB-1B), or multinational executives or managers (EB-1C). While the requirements for each sub-category vary, all three are designed for individuals who have reached a high level of success.

The primary benefit of the EB-1 categories is that none require Permanent Labor Certification (PERM) from the Department of Labor. This is a significant advantage, as it bypasses the lengthy process of proving there are no qualified U.S. workers for the position.

What is the EB-1 Validity Period?

Unlike temporary visas, the EB-1 green card is a permanent pathway. After the green card is granted, you will be eligible for U.S. citizenship after 5 years.

Can I Bring Dependents?

Yes, your spouse and children under the age of 21 qualify for an immigrant visa as well. Once the family members receive their green cards, they have full authorization to work for any U.S. employer.

While the Adjustment of Status (Form I-485) application is pending, they can apply for an Employment Authorization Document (EAD) via Form I-765 to begin working before the green card is officially issued.

What Are The EB-1 Visa Requirements?

The EB-1A for those with extraordinary ability is one of the most highly scrutinized green card categories. Applicants must meet at least three of the ten regulatory criteria:

Applicants for the EB-1B for outstanding professors/researchers must have at least 3 years of experience in teaching or research in that academic area and meet at least two of the six regulatory criteria

The EB-1C green card for multinational executives and managers has strict requirements that must be fulfilled by both the petitioner and beneficiary:

The person has receipt of lesser nationally or internationally recognized prizes or awards for excellence in the field of endeavor.

The person has membership in associations that require outstanding achievement of their members, as judged by recognized national or international experts.

The person has published material in professional or major trade publications or other major media relating to the person's work in the field for which classification is sought.

The person has served as a judge of the work of others in the same or an allied field of specification for which classification is sought.

The person has published original scientific, scholarly, artistic, athletic, or business-related contributions of major significance in the field.

The person has authored scholarly articles in the field, in professional or major trade publications or other major media.

The person has had their work displayed in the field at artistic exhibitions or showcase.

The person has performed in a leading or critical role for organizations or establishments that have a distinguished reputation.

The person has commanded a high salary, or other significantly high remuneration for services, in relation to others in the field.

The person has commercial successes in the performing arts, as shown by box office receipts or record, cassette, compact disk, or video sales.

The person has been awarded major prizes or awards for outstanding achievement

The person has membership in associations in the academic field that require outstanding achievements of their members

The person has published material in professional publications written by others about their work in the academic field.

The person has served as a judge, either individually or on a panel, of the work of others in the same or an allied academic field.

The person has original scientific or scholarly research contributions to the academic field.

The person has authorship of scholarly books or articles (in scholarly journals with international circulation) in the academic field

The U.S. petitioning employer must have a qualifying relationship with the foreign company where you worked abroad. This means the U.S. company must be a parent, subsidiary, or affiliate of the foreign entity.

You must have been employed outside the United States for at least one continuous year within the three years immediately preceding the filing of the petition (or your entry into the U.S. as a nonimmigrant).

Your year of employment abroad must have been in a primarily managerial or executive capacity.

The U.S. employer must offer you a permanent position that is also primarily managerial or executive in nature.

The U.S. employer must have been actively doing business for at least one year prior to filing the petition. You cannot use the EB-1C to open a new office.

The foreign employer must continue to do business and maintain the qualifying relationship with the U.S. company until you receive your green card.
