What is the E-2 Visa?

The E-2 visa is for foreign nationals from countries with an existing treaty with the United States to develop or carry out substantial investment activities in their business. It is also available for employees of the company.

What is the E-2 Visa Validity Period?

Initially, two years, with unlimited two-year extensions available. An E-2 visa holder may be eligible for an automatic two-year period of readmission when returning to the United States after traveling outside the country.

Can I Bring Dependents?

  • Spouse and children under the age of 21 can accompany you or join you later
  • Dependents are subject to the same period of admission as you.
  • Spouses automatically receive Employment Authorization incident to status.

What Are The E-2 Visa Requirements?

As the principal E-2 visa investor, you and your investment must meet several requirements:

For employees of E-2 treaty investors, several requirements must also be met:

You are a national of a country with which the United States maintains a treaty of commerce and navigation.

You have invested or are actively investing a substantial amount of capital in a bona fide enterprise in the United States.

You have at least 50% ownership of the company or have operational control through a managerial position or other corporate device.

You must place funds/assets at risk, meaning capital is subject to partial or total loss if the investment fails.

The investment must be substantial in relationship to the total cost of establishing the enterprise. The lower the cost of the enterprise, the higher the investment must be to be considered substantial.

The employee must be the same nationality as the principal employer

The individual must meet the legal definition of an "employee" under relevant U.S. law.

The employee must either primarily perform duties of an executive or supervisory nature or have special qualifications or skills essential to the efficient operation of the U.S. business.

The employee must intend to depart the United States when their E-2 status ends or is terminated.
