What Is The EB-2 Green Card?

The EB-2 green card is an employment-based permanent residency pathway that enables organizations to sponsor a foreign employee for a job role. Before the beneficiary can secure the role, the employer must first test the local job market to ensure there are no willing and qualified U.S. workers available for the position.

What is the EB-2 Green Card Validity Period?

Unlike temporary visas, the EB-2 green card is a permanent pathway. The physical green card is valid for ten years. After the green card is granted, you will be eligible for U.S. citizenship after 5 years.

Can I Bring Dependents?

Yes, spouses and children under the age of 21 also qualify for an immigrant visa. Once the family members receive their green cards, they have full authorization to work for any U.S. employer.

While the Adjustment of Status (Form I-485) application is pending, they can apply for an Employment Authorization Document (EAD) via Form I-765 to begin working before the green card is officially issued.

What Are The EB-2 Green Card Requirements?

To qualify for an EB-2 green card via the advanced degree sub-category, you must meet the following eligibility criteria:

To qualify for an EB-2 green card via the exceptional ability sub-category, you must meet at least 3 of the following eligibility criteria:

You must possess a U.S. advanced degree (Master’s or higher) or a foreign equivalent degree.

A U.S. Bachelor’s degree followed by at least five years of progressive, post-baccalaureate work experience in the specialty is considered equivalent to a Master’s.

The position you are applying for must specifically require an advanced degree or its equivalent.

Generally requires an approved labor certification from the Department of Labor, unless a National Interest Waiver is obtained.

Official academic record showing that you have a degree, diploma, certificate, or similar award from a college, university, school, or other institution of learning relating to your area of exceptional ability

Letters from current or former employers documenting at least 10 years of full-time experience in your occupation

A license to practice your profession or certification for your profession or occupation

Evidence that you have commanded a salary or other remuneration for services that demonstrates your exceptional ability

Membership in a professional association(s)

Recognition for your achievements and significant contributions to your industry or field by your peers, government entities, professional or business organizations

Other comparable evidence of eligibility is also acceptable.
