Background
In this case, VisaNation attorneys supported a global apparel company specializing in embroidery machinery, software, and garment printing. With operations in over 150 countries, the company has experienced significant growth since its establishment and has become a leader in the industry.
The company sought our legal expertise to secure EB-2 permanent residency for a purchase manager specializing in logistics, supply chain management, product sourcing, and experience with Salesforce and QuickBooks to integrate with their systems. In addition to these skills, it was a non-negotiable to have someone fluent in written and spoken Mandarin who could effectively negotiate, communicate, and establish strong relationships with Chinese suppliers and vendors.
VisaNation Case Strategy
Before the green card application, VisaNation attorneys supported the client, who was currently on H-1B status, through various aspects of the legal process, including:
The PERM Process
The PERM labor certification process exists to ensure that no willing and qualified U.S. workers are available for the position. As USCIS closely scrutinizes language requirements, we made a clear argument that the role could not be performed effectively without Mandarin, establishing it as a “business necessity” rather than a mere preference. Additionally, skills in scheduling international marine transportation and domestic freight made them uniquely qualified.
We also supported the client with the job market test, guiding the Sunday print ads in a highly circulated newspaper, a 30-day state job order, and additional recruitment via the company website and professional job boards. Ultimately, no candidates were found that could meet the high eligibility requirements for the job role that the green card beneficiary had.
Ability to Pay and Academic Qualifications.
By evidencing the company’s tax returns, we showcased that the company was in a strong financial position to pay the offered salary of the beneficiary.
Additionally, we showcased the beneficiary’s Master’s degree, a key requirement listed for the job.
Priority Date Retained
Perhaps the most successful part of the case was retaining a priority date from a previous employer, significantly reducing the EB-2 green card processing time. We also requested premium processing, reducing the timeline further.
Verdict
After submitting a comprehensive 1-140 petition, including 70 pages of documentation, VisaNation attorneys secured a rapid approval in just 12 business days. This swift adjudication ensures the petitioner and beneficiary can move forward with the next steps without delay. Additionally, the client, currently on H-1B status, is now eligible for unlimited extensions until their priority date is current.
